Welcome to OsteoViewer. These Terms & Conditions (“Terms”) govern your access to and use of the OsteoViewer application, website, and related services (collectively, the “Service”). By accessing or using OsteoViewer, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

Nature of the Service

OsteoViewer is a software platform designed for the visualization and interaction with DICOM and CBCT imaging data.

OsteoViewer is provided for informational, and visualization purposes only.

The Service is not intended to replace professional clinical judgment and must not be relied upon for diagnosis, treatment planning, surgical guidance, or medical decision-making of any kind.

OsteoViewer is not a certified medical device and has not been approved or cleared by any regulatory authority unless explicitly stated otherwise.

Eligibility

By using the Service, you represent and warrant that:

  • You are legally capable of entering into binding agreements
  • You will use the Service in compliance with all applicable laws and regulations
  • You are authorized to upload and access any files or data submitted to the platform

User Accounts

You may be required to create an account to access certain features of the Service.

You are solely responsible for:

  • Maintaining the confidentiality of your account credentials
  • Restricting access to your account
  • All activity occurring under your account

You agree to immediately notify OsteoViewer of any unauthorized use or security breach involving your account.

OsteoViewer reserves the right to suspend or terminate accounts at its sole discretion.

User Data and Uploaded Content

Users retain ownership of all uploaded files, scans, images, and related content submitted through the Service.

By uploading content, you represent and warrant that:

  • You possess all necessary rights and permissions to upload such content
  • The upload and use of such content does not violate any law, privacy regulation, or third-party rights

You are solely responsible for ensuring that any uploaded patient-related data complies with all applicable privacy and data protection laws, including proper anonymization where required.

OsteoViewer does not assume responsibility for verifying the legality or ownership of uploaded content.

Medical Disclaimer

The Service must not be used as the sole basis for:

  • Medical diagnosis
  • Treatment planning
  • Implant planning
  • Surgical procedures
  • Clinical decision-making

All clinical interpretations, patient-related decisions, and medical judgments remain solely the responsibility of the licensed healthcare professional using the Service.

Users acknowledge that imaging data, reconstructions, measurements, orientations, and visualizations may contain inaccuracies, distortions, or technical limitations. Medical Disclaimer

No Warranty

The Service is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied.

To the fullest extent permitted by law, OsteoViewer disclaims all warranties, including but not limited to:

  • Accuracy
  • Reliability
  • Availability
  • Fitness for a particular purpose
  • Non-infringement
  • Uninterrupted functionality
  • Error-free operation

OsteoViewer does not guarantee that:

  • Measurements are clinically accurate
  • Reconstructions are free from distortion
  • Uploaded files will always display correctly
  • The Service will operate without interruption or defects

Limitation of Liability

To the maximum extent permitted by law, OsteoViewer, its owners, affiliates, developers, employees, contractors, and partners shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to:

  • Use or inability to use the Service
  • Reliance on any output, measurement, reconstruction, or visualization
  • Clinical decisions or patient outcomes
  • Data loss
  • Unauthorized access
  • System interruptions or software defects

Users assume full responsibility for all use of the Service and all consequences arising from such use.

Intellectual Property

All rights, title, and interest in the Service, including but not limited to:

  • Software
  • Code
  • Design
  • Logos
  • Branding
  • User interface
  • Graphics
  • Documentation

remain the exclusive property of OsteoViewer and its licensors.

Users may not:

  • Copy
  • Modify
  • Reverse engineer
  • Distribute
  • Resell
  • Republish
  • Exploit

any part of the Service without prior written authorization.

Prohibited Use

Users agree not to:

  • Use the Service unlawfully
  • Upload malicious or harmful files
  • Attempt unauthorized access to systems or accounts
  • Interfere with platform security or operation
  • Use the Service in violation of medical, privacy, or data protection regulations
  • Misrepresent OsteoViewer as a certified medical device

Service Modifications

OsteoViewer reserves the right to:

  • Modify features
  • Restrict access
  • Suspend functionality
  • Update or discontinue the Service

at any time without prior notice.

Termination

OsteoViewer may suspend or terminate access to the Service at any time and without liability if a user violates these Terms or engages in conduct deemed harmful to the platform or other users.

Continued use of the Service following any changes constitutes acceptance of the updated Terms.

These Terms shall be governed and interpreted in accordance with the applicable laws of the jurisdiction determined by OsteoViewer, without regard to conflict of law principles.
